TERMS OF SERVICE

OVERVIEW

This website is operated by Smokestead. Throughout the site, the terms “we,” “us,” and “our” refer to Smokestead. Smokestead offers this website, including all information, products, and services available through it, conditioned upon your acceptance of these Terms of Service.

By visiting our site, creating an account, or purchasing from us, you agree to these Terms of Service and to our Return and Refund Policy, Privacy Policy, Shipping Policy, and any other policies posted on the site. If you do not agree, do not use the site or place an order.

We may update these Terms by posting a revised version on this page. Changes apply prospectively from the date they are posted, except where applicable law requires otherwise.

AGE AND LEGAL ELIGIBILITY

You must be at least 21 years old to access age-restricted portions of this site or purchase pipes, pipe tobacco, or other regulated tobacco products or components from Smokestead. If the minimum legal age in your location is higher than 21, you must meet that higher age requirement.

By placing an order, you represent that you are legally permitted to purchase, receive, possess, and use the products in your jurisdiction. You may be required to complete age or identity verification. We may refuse, hold, or cancel an order if verification cannot be completed or if we believe a transaction may violate applicable law. Misrepresenting your age or purchasing for an underage person is prohibited.

LAWFUL USE

Products sold by Smokestead are intended only for lawful use by adults. You may not use the site or our products for any unlawful purpose or in violation of federal, state, provincial, local, or international law. You are responsible for understanding and following the laws that apply where you purchase, receive, possess, or use a product.

PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, measurements, colors, materials, condition, and photographs accurately. Screen settings, lighting, photography, natural materials, and handcrafted production can affect appearance. Natural variations in wood grain, sandblasting, color, and finish are not necessarily defects.

Many Smokestead pipes are handmade, one of a kind, or available in limited quantities. Product availability is not guaranteed. We may correct errors, update information, limit quantities, or discontinue products at any time.

Inspect your pipe before smoking or using it. A pipe that has been smoked, used, modified, reamed, chemically cleaned, or otherwise altered is not eligible for return or refund to the extent permitted by law. Additional details are provided in our Return and Refund Policy.

ORDERS AND ACCEPTANCE

Your order is an offer to purchase. An automated order confirmation acknowledges receipt but does not guarantee acceptance. We may accept, reject, limit, hold, or cancel an order for reasons including product availability, suspected fraud, pricing or listing errors, age-verification failure, payment issues, shipping restrictions, or legal and regulatory requirements.

If we cancel an order after payment has been collected, we will refund the amount collected for the cancelled portion to the original payment method. We may limit or prohibit orders that appear to be placed by dealers, resellers, distributors, or individuals attempting to circumvent purchase limits.

PRICES, BILLING, AND PAYMENT

Prices are shown in the currency displayed at checkout and may change without notice. Taxes, shipping costs, duties, brokerage fees, and other charges may be added where applicable and will be shown or described at checkout when reasonably available.

You agree to provide current, complete, and accurate billing, payment, contact, and shipping information. You authorize us and our payment providers to charge the payment method provided for all amounts associated with your order. We are not responsible for fees charged by your bank, card issuer, payment provider, customs authority, or other third party.

SHIPPING, DELIVERY, AND RISK

Shipping estimates are estimates and are not guarantees unless expressly stated otherwise. Delays may occur because of carriers, weather, customs, address problems, regulatory reviews, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Risk of loss and title transfer as provided by applicable law and the shipping terms for the order. Contact us promptly if tracking shows delivery but you cannot locate the package, or if the shipment arrives damaged.

RETURNS AND REFUNDS

Returns, exchanges, damaged-item claims, and refunds are governed by our Return and Refund Policy. That policy includes a 14-day period to report damaged, defective, or incorrect items and a 30-day return-request period for eligible unused products. Smoked or altered pipes are nonreturnable to the extent permitted by law.

INTERNATIONAL ORDERS

You are responsible for determining whether a product can lawfully be imported, delivered, possessed, or used in the destination country. International shipments may be inspected, delayed, rejected, returned, seized, or assessed duties, taxes, brokerage fees, and other charges by local authorities.

Unless otherwise authorized in writing by Smokestead, international sales are final, subject to mandatory or non-waivable consumer rights in the customer’s country or region. Customers are responsible for customs charges, import duties, taxes, brokerage fees, and related costs unless applicable law requires otherwise. Refusal to pay these charges does not automatically create a right to a refund.

HEALTH AND SAFETY

Smoking and tobacco use involve serious health risks. Smokestead does not provide medical advice and makes no representation that any product is safe or risk free. Product information is provided for general informational purposes and is not a substitute for professional medical advice. Use, maintain, and store products responsibly and keep them away from children and pets.

Unless a product listing expressly states otherwise, pipes do not include tobacco or other consumable substances.

INTELLECTUAL PROPERTY

The site and its content, including the Smokestead name, logos, branding, product photography, text, graphics, design, and other materials, are owned by Smokestead or used with permission and are protected by applicable intellectual-property laws. You may use the site for personal, noncommercial shopping purposes only. You may not copy, reproduce, republish, sell, distribute, modify, scrape, or commercially exploit site content without prior written permission.

CUSTOMER CONTENT AND COMMUNICATIONS

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not infringe another person’s rights. You grant Smokestead a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with operating and promoting the business, unless applicable law requires otherwise.

You may not submit unlawful, abusive, deceptive, defamatory, infringing, obscene, malicious, or harmful content. We may remove or decline to use submitted content, but we are not obligated to monitor all submissions.

PROHIBITED CONDUCT

You may not use the site to violate any law; purchase for or supply products to an underage person; infringe intellectual-property rights; submit false or misleading information; transmit malware or harmful code; collect personal information about others without authorization; interfere with site security or operation; scrape or automate access without permission; commit fraud; harass others; or circumvent age, geographic, purchase, or security restrictions.

THIRD-PARTY SERVICES AND LINKS

The store may use or link to third-party services, including Shopify, payment processors, carriers, age-verification providers, social networks, and external websites. We do not control and are not responsible for third-party content, availability, policies, or practices. Your use of third-party services may be governed by separate terms.

DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, the site and its content are provided “as is” and “as available.” We do not warrant that access will be uninterrupted, secure, timely, or error free. Any warranties that cannot legally be excluded remain in effect.

Nothing in these Terms excludes warranties, guarantees, remedies, or consumer rights that cannot be waived under applicable law.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Smokestead and its owners, employees, agents, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost revenue, lost data, or similar losses arising from use of the site or products.

Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, willful misconduct, or any other liability that cannot legally be limited.

INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Smokestead and its owners, employees, agents, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the site or products, your violation of these Terms, or your infringement of another party’s rights.

SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.

TERMINATION

We may suspend or terminate access to the site or cancel orders if you violate these Terms or applicable law. Obligations and liabilities incurred before termination, along with provisions that by their nature should survive, will continue after termination.

GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Virginia and applicable United States federal law, without regard to conflict-of-law principles. This provision does not deprive consumers of mandatory protections available under the laws of their place of residence.

ENTIRE AGREEMENT

These Terms and the policies posted on the site constitute the entire agreement between you and Smokestead concerning use of the site and purchases from us, except for any additional terms expressly agreed to in writing.
